By engaging our services, submitting any forms on our website, or otherwise using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. About Migration Overseas

Migration Overseas is an India-based immigration consultancy firm established in 1998, providing professional guidance for international migration, student visas, work permits, permanent residency, family sponsorship, and business/investor visas. We serve clients from India and throughout the world, assisting with immigration to destinations including Canada, Australia, United Kingdom, United States, Germany, New Zealand, and other countries across Europe, Asia, and the Middle East.

2. Services Provided

Our services include, but are not limited to:

Immigration Consultancy: Professional assessment of your eligibility for various immigration programs, personalized advice on suitable pathways, and strategic guidance throughout the immigration process.

Application Preparation: Assistance with documentation, form filling, application compilation, submission guidance, and follow-up with immigration authorities on your behalf where authorized.

Study Visa Services: Guidance on university and college admissions, course selection, student visa applications, and post-study immigration pathways.

Test Preparation: Coaching and preparation for language proficiency tests such as IELTS, PTE, TOEFL, CELPIP, and TEF.

Settlement Services: Pre-departure orientation, accommodation guidance, and initial settlement support in coordination with our partner institutes and associates.

3. Partner Institutes and Associates

Migration Overseas works with a network of partner institutes for education placement, skills assessment, settlement services, and other immigration-related support. Partner institutes can be direct as well as indirect via our associates. This means:

Direct Partner Institutes: Educational institutions, assessment bodies, and service providers with whom Migration Overseas has a direct contractual or referral relationship.

Indirect Partner Institutes (via Associates): Institutions and service providers that are connected to Migration Overseas through our authorized associates, agents, or affiliated consultants operating in India or abroad.

By engaging our services, you acknowledge and consent to your information being shared with relevant partner institutes — whether direct or indirect — as necessary to facilitate your immigration, education, or settlement objectives. Migration Overseas takes reasonable steps to ensure that all partner institutes and associates maintain appropriate standards of service and data protection.

4. No Guarantee of Visa Success

While we provide expert guidance and professional support throughout your application process, the final decision on all visa and immigration applications rests solely with the respective government immigration authorities (such as IRCC, Department of Home Affairs, UKVI, USCIS, and other relevant bodies). Migration Overseas does not guarantee visa approval, invitation to apply, permanent residency grant, or any specific immigration outcome.

Immigration decisions are made by government departments based on their assessment of your application against their criteria and policies, which may change without prior notice. Our role is to provide accurate information, professional guidance, and thorough preparation to maximize your chances of a favorable outcome.

Any representations made by Migration Overseas regarding eligibility scores, processing times, or chances of success are based on our professional assessment and publicly available government information at the time of consultation and do not constitute a guarantee.

5. Client Responsibilities

As a client of Migration Overseas, you agree to:

Provide Accurate Information: Supply truthful, complete, and accurate information in all documents and forms. Any misrepresentation or omission may result in application refusal and termination of our services without refund.

Timely Cooperation: Respond to our requests for information and documents within the timelines communicated to you. Delays caused by your non-cooperation may affect your application.

Financial Obligations: Pay all applicable fees as per the agreed fee structure and within the specified timelines. Government fees, visa application fees, and third-party charges are separate from our consultancy fees and are non-refundable by us.

Compliance with Laws: Comply with all immigration laws and regulations of both India and the destination country. You shall not use our services for any unlawful purpose.

Disclosure of History: Disclose any previous visa refusals, criminal records, medical conditions, or other factors that may affect your application.

6. Fees and Payments

Our consultancy fees are communicated to you prior to engagement and are governed by a separate service agreement. Key terms include:

All fees are quoted in Indian Rupees (INR) unless otherwise specified. Government and embassy fees, visa application charges, medical examination costs, police clearance charges, language test fees, credential evaluation fees, and other third-party charges are payable directly by you and are not included in our consultancy fees. Payments are to be made through authorized modes including bank transfer, UPI, or payment gateway as specified. GST and applicable taxes will be charged as per prevailing Indian tax laws. Refund policy is governed by the terms of your individual service agreement with Migration Overseas.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

Migration Overseas shall not be liable for any visa refusal, delay, or adverse decision by any immigration authority. We shall not be held responsible for changes in immigration laws, policies, or processing procedures that occur after you have engaged our services. Our total liability to you for any claim arising out of or related to our services shall not exceed the consultancy fees paid by you to us. We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of opportunity, travel expenses, or emotional distress. We are not liable for any loss or damage arising from your failure to provide accurate or complete information, or from your failure to meet deadlines communicated to you.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, software, and other materials, is the property of Migration Overseas or its content suppliers and is protected under Indian copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

9. Confidentiality

We treat all client information as strictly confidential and shall not disclose your personal information to any third party except as required for the purpose of your immigration application, as authorized by you, as required by law, or as described in our Privacy Policy. This obligation of confidentiality survives the termination of our engagement.

10. Termination

Either party may terminate the service engagement by providing written notice. In case of termination, the refund of consultancy fees (if any) shall be governed by the terms of your individual service agreement. Migration Overseas reserves the right to terminate services immediately if the client provides false or misleading information, engages in abusive or threatening behavior toward our staff, fails to meet payment obligations after due notice, or uses our services for any unlawful purpose.

11. Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be governed by the laws of India. The parties shall first attempt to resolve disputes through good-faith negotiation. If unresolved, disputes shall be referred to arbitration in Vadodara, Gujarat, India, in accordance with the Arbitration and Conciliation Act, 1996. The courts of Vadodara, Gujarat shall have exclusive jurisdiction over any matters not subject to arbitration.

12. Disclaimer

The information provided on our website and during consultations is for general informational purposes and professional guidance. 13. Force Majeure

Migration Overseas reserves the right to modify these Terms at any time. Changes will be effective upon posting on this page with a revised "Last Updated" date. Your continued use of our services after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
